Thailand Crypto Court Case: Bitcoin Officially Recognized as Legal Property

Thailand's Supreme Court officially recognizes Bitcoin as legal property following a landmark ruling that establishes digital assets under the country's criminal law.

This pivotal decision ensures that cryptocurrencies can be valued, owned, and recovered in theft cases just like traditional physical assets.

Key Takeaways

  • Thailand's top court has classified Bitcoin as property.
  • The ruling stems from a 2022 robbery on Koh Samui.
  • Bitcoin remains prohibited as legal tender for daily payments.

The Landmark Crypto Robbery Case

The historic decision, numbered 4929/2569, originated from a violent incident on the resort island of Koh Samui in September 2022. A group of foreign nationals threatened a victim and his wife, using fears for their child's safety to force a transfer of funds.

Under duress, the victim converted roughly $50,000 into 2.480801 Bitcoin and sent it to a wallet controlled by the perpetrators. The defendant in the case organized the group's transport, lodging, and subsequent escape.

Lower courts found the defendant guilty of joint robbery, coercion, and assault. The initial 15 year prison sentence was reduced to 10 years due to cooperation during the investigation.

The defendant appealed the conviction, arguing that Bitcoin lacked intrinsic value and therefore could not qualify as property taken under the law.

Why the Court Declared Bitcoin Property

The Supreme Court rejected the defendant's argument. The justices found that the crypto asset possesses demonstrable economic value, can be traded on international markets, and can be converted into cash.

The court relied on Sections 137 and 138 of the Civil and Commercial Code, which extend property rights to intangible things that carry possessory value.

It also referenced the 2018 Emergency Decree on Digital Asset Businesses, which defines crypto assets as electronic data built on a network to serve as a medium of exchange.

The court upheld the conviction based on consistent witness testimony and transaction records. The defendant is now required to return the 2.48 Bitcoin or pay 1.878 million baht in compensation.

Property Rights vs. Legal Tender

While this Thailand Supreme Court crypto decision solidifies ownership rights, it does not make Bitcoin a currency. The court drew a clear line between owning an asset and spending it.

Under Thailand's Currency Act, digital assets cannot be used to settle domestic debts or replace the national banking system. The court deferred to the Bank of Thailand, which refuses to treat digital assets as a means of payment due to their price swings.

This separation means crypto holdings can now be seized, divided in bankruptcy, passed on through inheritance, and recovered in theft cases. However, investors who want to spend their coins generally must convert them into baht through licensed exchanges.

The Securities and Exchange Commission previously banned the direct use of cryptocurrencies for goods and services, with penalties of up to 300,000 baht.

Impact on the Thai Crypto Market

This legal precedent arrives as Thailand continues to build out a regulated digital asset market. While direct payments are restricted, authorities are actively courting investment.

Capital gains tax on digital asset sales through licensed platforms was scrapped from January 2025 through December 2029.

In August 2025, the securities regulator launched TouristDigiPay, an 18 month sandbox allowing visitors to convert crypto into baht for spending. Merchants receive baht, keeping the program compliant with payment rules.

Additionally, a new regulation took effect on October 16, 2026, allowing Bitcoin and Ethereum exchange traded funds to list on the Stock Exchange of Thailand.

Before this ruling, the absence of a clear legal definition for digital property left victims of crypto theft with few options.

The new precedent provides a framework for courts to treat compromised coins as recoverable assets and helps creditors navigate corporate bankruptcies involving digital holdings.
